Zoobification™ Limited Credit Warranty
This Zoobification™ Limited Credit Warranty (“Warranty”) describes the terms under which Zooby Neighborhood Services, Inc. (“Zooby,” “we,” or “us”) provides a credit toward a future roof replacement following the purchase of Zoobification™ services.
1. Nature of Service
Zoobification™ is a roof-life extension and maintenance service intended to improve the condition and performance of qualifying asphalt shingle roofs.
Zoobification™:
Is not a roof replacement
Does not guarantee avoidance of future roof replacement
Does not extend or replace any manufacturer’s warranty on roofing materials
2. Credit Toward Future Roof Replacement
If a complete roof replacement becomes necessary after Zoobification™, Zooby will apply a credit toward the cost of a full roof replacement performed and completed by Zooby, subject to the following terms:
A. Within Twelve (12) Months
If a complete roof replacement is required within twelve (12) months of the Zoobification™ service date, 100% of the Zoobification™ purchase price will be credited toward the replacement.
B. After Twelve (12) Months
After twelve (12) months, the credit will be prorated evenly over a six (6) year period, beginning on the original Zoobification™ service date.
3. Application of Credit
The credit will be applied as a dollar-for-dollar reduction to Zooby’s contract price for a complete roof replacement.
The credit has no cash value.
The credit is non-refundable.
The credit may not be applied to:
Partial roof replacements
Repairs
Maintenance services
Work performed by third parties
Replacement Determination
The determination of whether a complete roof replacement is required shall be made solely by Zooby, in its reasonable professional judgment, based on inspection and evaluation of the roof.
4. Eligibility and Scope
This Warranty applies only to the original purchaser of Zoobification™ and the specific residential property where the service was performed.
This Warranty is non-transferable and does not survive a sale, transfer, or conveyance of the property.
The credit applies only to complete roof replacement services quoted and performed by Zooby.
A complete roof replacement estimate will be provided alongside any Zoobification™ estimate to allow informed decision-making.
5. Voiding of Warranty
This Limited Credit Warranty shall be void if, after Zoobification™, any of the following occur without Zooby’s prior written consent:
Repairs, alterations, or modifications performed by a third party
Installation of additional rooftop equipment or penetrations, including but not limited to:
Solar panels
Satellite dishes
Antennas
HVAC components
Failure to reasonably maintain the roof according to ordinary residential maintenance standards
Damage caused by misuse, neglect, fire, impact, hail, wind, storms, acts of God, or other conditions beyond Zooby’s control
6. Exclusions and Limitations
This Warranty does not cover or apply to:
Normal wear and tear
Structural issues, decking failure, framing deficiencies, or underlying building defects
Leaks or failures unrelated to the shingles treated as part of Zoobification™
Pre-existing conditions not reasonably observable at the time of inspection
Roofs that Zooby determines are unsuitable for Zoobification™, but which are treated at the customer’s insistence
7. Disclaimer of Other Warranties
TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, THIS LIMITED CREDIT WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY ZOOBY IN CONNECTION WITH ZOOBIFICATION™.
ZOOBY EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
8. Governing Law and Venue
This Warranty shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.
Venue for any dispute arising out of or relating to this Warranty shall lie exclusively in the county in Texas where the serviced property is located.
9. Limitation of Liability
In no event shall Zooby’s total liability arising out of or relating to Zoobification™ or this Warranty exceed the original Zoobification™ purchase price, except for the application of the credit expressly described in this Warranty.
